Hoy used a stolen 9 mm handgun seriously wounding his stepdad in the leg and abdomen while outside of the Waffle House at the corner of Murtland Avenue and Oak Spring Road in South Strabane Township around 1 a.m., area police detail in the affidavit of probable cause.

The stepdad got into his car and drove himself to the hospital. When asked about the shooting he identified the teen as "Sam Hoy, he's my stepson," the police say in the affidavit.

His condition quickly worsened and he was flown to UPMC Presbyterian Hospital Pittsburgh where he "underwent immediate surgery, and parts of his colon and small intestine were removed. At the time of this affidavit, (he) was still in surgery to save his life as a result of the gunshot wounds to his abdomen and lower leg," Sgt. Kenneth Torboli states in the affidavit.

Police soon learned that witnesses had seen two teens running from the parking lot, and Sam Hoy was found behind Penn Commerical Oak Springs Plaza by Patrolman John Tegley.  A 9 mm gun was found in his front pocket, police detailed in the affidavit.

The serial number on the gun was traced to the owner who had reported it missing to Washington City police when it was stolen from his car while it was parked outside of his home on Dec. 7.

Hoy was interviewed in front of his mom and admitted to shooting his stepdad twice with the stolen gun, the police state in the court documents.

Hoy has been charged as an adult with Criminal Attempt - Criminal Homicide, felony Aggravated Assault - Attempts to cause Serious Bodily Injury or causes injury with extreme indifference, felony Receiving Stolen Property, and a misdemeanor for Possession Of a Firearm By a Minor, according to his court docket.

His bail was set at $2 million and he was remanded to the Washington County Prison until his preliminary hearing set before Magisterial District Judge Michael L. Manfredi on Dec. 27 at 10 a.m., according to his court docket.

There was no information available about the other teenager who supposedly was seen fleeing the area of the shooting and no update on the victim's status has been released at the time of this publication.
